A Texas judge has issued a temporary restraining order against former U.S. Representative Beto O’Rourke and his political action committee, Powered by People, which prohibits the group from financing Democratic state lawmakers who fled the state to protest a Republican-led redistricting plan that could potentially yield five additional congressional seats for the GOP.

This ruling represents an early triumph for Texas Attorney General Ken Paxton, who filed a lawsuit asserting that O’Rourke’s PAC was supporting the absent Democrats, contributing to the Texas House’s inability to meet quorum requirements. With the lawmakers still out of state, GOP officials are considering measures to remove them from office or pursue civil arrests.

Judge Megan Fahey’s order prevents Powered by People from using political contributions to cover expenses such as travel, accommodations, or meals for the legislators who have relocated to Illinois, California, and other states. The group is also restricted from raising funds for these purposes. This order is set to last for two weeks, with a hearing scheduled for August 19 to determine its future.

The allegations from Paxton include claims of deceptive fundraising practices and bribery aimed at financing the travel and living expenses of the lawmakers, who deliberately left Texas to disrupt the legislative process. He alleges that O’Rourke and his PAC misled donors into believing their contributions would fund political activities when, in fact, they allegedly went toward personal benefits like private jet travel and luxury lodging.

In response, O’Rourke has filed a countersuit, asserting that Paxton’s actions are aimed at stifling dissent and dismantling a significant voter registration effort. O’Rourke contends that Paxton is attempting to suppress the work of Powered by People, which focuses on engaging volunteers to register voters and mobilize Democratic support. He cited the organization’s previous efforts, which included connecting seniors to vital resources during the 2021 winter storm.

Despite this legal challenge, O’Rourke reaffirmed his commitment to fighting for voting rights and free elections, stating that he plans to participate in a rally in Fort Worth. He emphasized his determination to continue leading the organization he believes threatens established political powers in Texas.

In parallel, Attorney General Paxton has initiated a separate lawsuit against 13 Democratic lawmakers, petitioning the Texas Supreme Court to declare their legislative seats vacant due to their absence during the special session.

This situation highlights the continuing political tensions in Texas and the lengths to which both parties may go to secure their objectives. O’Rourke’s resolve to persist in his activism, despite legal hurdles, reflects the ongoing struggle for voting rights and representation in the state.
