StubHub promotes its “FanProtect Guarantee,” which asserts that all tickets purchased through its platform are valid. If a ticket is deemed invalid, the company promises to provide comparable or better tickets or a refund. However, the terms of this guarantee are more complex, as the determination of what constitutes “comparable or better” seats is made at StubHub’s “sole discretion” and takes into account various factors such as cost and availability.
Christensen contends that despite StubHub highlighting this guarantee to attract customers, it often sidesteps its obligations, leaving fans with seats that do not match the quality they originally paid for. The lawsuit claims that with only forty minutes until the concert began, Christensen had no choice but to accept the inferior tickets provided by StubHub. Her legal team argues that StubHub exploits the lack of alternatives for consumers, forcing them into unfavorable positions.
This lawsuit potentially represents a significant number of consumers, with claims that hundreds of thousands, if not millions, may have experienced similar issues with StubHub.
