The St. Joseph County Prosecutor’s office has determined that the shooting death of Jerry Barnette, 56, at a gas station in South Bend in May was justified, leading to no criminal charges being filed.

The incident occurred on May 21 inside Logan Quick Mart on South Logan Street, where Barnette was found suffering from gunshot wounds and later pronounced dead at the scene on June 17. A juvenile involved in the shooting was located in Mishawaka with non-life-threatening injuries and received medical treatment.

According to the findings from the South Bend Police Department’s Violent Crimes Unit, a thorough investigation included reviewing surveillance footage. It revealed that Barnette and the juvenile were in discussion outside of the gas station before the juvenile entered the store. Barnette subsequently followed him inside, armed with a firearm, and the two exchanged gunfire.

Following the review of all evidence, which supported the claim of self-defense, the prosecutor’s office concluded they could not disprove this assertion, leading to the decision not to pursue charges against the juvenile.

This incident highlights the complex nature of self-defense cases and the investigative procedures undertaken by law enforcement to ensure justice. While the loss of life is tragic, the ruling emphasizes the importance of assessing all evidence carefully in such situations.
