Critics, particularly attorney Ben Sessions, claim that Howard has improperly dismissed a high number of DUI cases without adequately considering the evidence, even before receiving crucial blood test results.
Sessions pointed out that Howard dismissed cases involving defendants with blood-alcohol concentrations significantly over the legal limit, stating that some had levels as high as 0.20, which is more than twice the legal threshold in Georgia of 0.08. He argues that such actions undermine public safety and accountability, as these defendants were not subject to standard penalties like probation or community service.
