In a discussion with conservative influencer Charlie Kirk, Mr. Newsom was prompted to address the participation of a specific transgender athlete in an upcoming track meet. He noted that he had considered ways to create a balance between competitive fairness for transgender girls and the concerns raised by other athletes, yet admitted, “I just couldn’t figure out how to, quote, unquote, make this fair.”

The plaintiffs, two high school athletes from Riverside, contended they missed chances to compete on their girls’ cross-country team due to a transgender girl being permitted to participate. U.S. Attorney Bill Essayli asserted, “The law is clear: Discrimination on the basis of sex is illegal and immoral,” emphasizing the Department of Justice’s commitment to safeguarding girls’ sports and ensuring compliance with civil rights protections.
