Elon Musk has initiated legal proceedings against the state of New York, contesting the constitutionality of the newly enacted Stop Hiding Hate Act, which targets hate speech on social media platforms. Musk argues that the law infringes on free speech rights protected by the First Amendment.

Signed by Governor Kathy Hochul in December, this law requires tech companies to disclose their terms of service and provide regular reports on how they moderate extremist content, hate speech, and misinformation on their platforms. With the law now in effect, Musk is opposing specific provisions that he claims could force X to disclose sensitive operational details. Additionally, Musk is contesting the potential fines of $15,000 per day for violations, framing these requirements as a violation of free speech.

The legislation was developed by State Senator Brad Hoylman-Sigal and Assemblymember Grace Lee, with support from the Anti-Defamation League, in an effort to hold tech firms accountable for harmful content circulating on their networks. The authors countered Musk’s objections, asserting that his lawsuit attempts to abuse the First Amendment to avoid granting New Yorkers the transparency they deserve regarding social media company responsibilities in moderating content.

In a statement reflecting on the recent rise in political violence linked to hate speech dissemination, Hoylman-Sigal and Lee emphasized the importance of knowing how companies like X are tackling these issues.

In addition to his challenge to New York’s law, Musk has also taken legal action against similar regulations in California, maintaining a consistent stance against content moderation since acquiring the platform in 2022. While Musk portrays himself as a “free speech absolutist,” he has faced criticism for retaliating against media outlets that publish unfavorable reports about him.
