Minnesota State Senator Nicole Mitchell, who was recently convicted of first-degree burglary and possession of burglary tools, has announced her intention to resign next month. Her lawyers indicated that she will step down by no later than August 4, allowing her two weeks to finalize legislative projects, manage constituent services, transition her staff, and ensure her son has health insurance coverage since he is currently insured through her position.

This decision comes after a jury found Mitchell guilty following her arrest in April 2024, where she was discovered in her stepmother’s basement dressed in black, equipped with a flashlight. Police reported that she claimed to have entered the house through the basement window to retrieve belongings related to her late father amidst an ongoing family dispute. At the time of her arrest, she acknowledged her actions, stating, “I know I did something bad,” but later denied intentions to steal, claiming her purpose was merely to check on her stepmother, who suffers from Alzheimer’s disease.

The consequences of her conviction are significant, as first-degree burglary in Minnesota carries a sentence ranging between six months and 20 years in prison. Mitchell’s resignation follows a challenging period for the Minnesota Senate, which has seen political contention, particularly among the narrow majority held by the Democrats after a special election.

Republican leader Mark Johnson has criticized Mitchell’s timeline for her resignation, emphasizing that her felony convictions necessitate her immediate departure from the Senate.
