Kratom Controversy: Family Sues After Tragic Death Raises Safety Concerns

A lawsuit has been filed following the death of Robert Simmons, who reportedly suffered from acute mitragynine toxicity, commonly referred to as kratom toxicity. The complaint claims that Simmons was misled by the defendants, who reportedly set up a network of shell companies to import and sell kratom with the intent of financial gain. His family believes he was deceived into thinking kratom was a safe and natural product for managing chronic pain.

The lawsuit alleges that the defendants failed to disclose important safety information about kratom and did not provide adequate warning labels on their products. Moreover, it highlights that kratom has not been approved by the U.S. Food & Drug Administration (FDA) for any medical uses, despite claims made by the companies that sell it.

Tamara Spires, an attorney representing Simmons’ family, expressed concerns about the deceptive practices of these kratom companies, particularly those associated with O.P.M.S. kratom products. She emphasized that the case aims to shed light on the risks and dangers associated with kratom.

Kratom has been linked to multiple fatalities nationwide, and this lawsuit reflects a growing movement to confront the hazards posed by this product. The wrongful death lawsuit (Case No. 2024CV30847) was filed by Simmons’ widow, Erika Simmons, on September 23, 2024, in Weld County District Court. The defendants include multiple entities, such as One Love, Inc., Jonah V. Ricke, and others heavily involved in the kratom trade.
