New insights have emerged regarding the false advertisement lawsuit concerning the Switch version of Knights of the Old Republic 2, featuring a notable argument presented by an expert retained by Aspyr. This expert contended that the fan-created Restored Content mod, which was referenced in the lawsuit related to the missing DLC, holds “no economic value.”

This information has been detailed by Game File, which analyzed the ongoing legal dispute between Aspyr, the game developer, and an individual who initiated the lawsuit after discovering that DLC promoted in a trailer for the Switch version was not included in the final release.

Aspyr has put forth several defenses aimed at diminishing the lawsuit’s impact, culminating in a settlement earlier this year. Among their claims was the assertion that the DLC tease was minimally visible to consumers, as it was shown at the end of a YouTube trailer. Aspyr’s legal team argued that “many YouTube viewers skip [videos] after the first five seconds.”

In April, Aspyr introduced additional documents, including expert testimony from former Blizzard product manager Frank Gilson. He noted that the Restored Content mod, on which the missing DLC was based, was developed by fans and distributed free of charge. This led him to conclude it had no “economic value” due to the nature of community-generated mods that are typically offered without cost.

The lawsuit took some unexpected turns, delving into unusual and colorful allegations, such as claims of demonic possession. This peculiar assertion arose when an Aspyr attorney was reported to have shouted at a client: “as if possessed by a demon.” The attorney in question disputed this characterization, arguing that he simply needed to raise his voice to make his point and redirect the conversation toward more constructive dialogue.

Another notable claim from the proceedings suggested that it could take decades to uncover the correct email addresses necessary for securing rights to create a Star Wars game. This stems from documents submitted in April, which had certain email addresses redacted, labeled as revealing “a key trade secret” concerning crucial contacts at Lucasfilm.

Despite the complications surrounding this chapter of the KOTOR saga, there remains a bright future for fans of the franchise. During The Game Awards, the new project Fate of the Old Republic was announced, with the involvement of Casey Hudson, a key figure associated with the original Knights of the Old Republic and Mass Effect.
