Justice Dane Tuiqereqere has delivered a firm warning to Apisai Madigibuli, currently in custody for the alleged murder of his pregnant wife, regarding his repeated bail applications. During a hearing at the High Court in Suva on October 22, Justice Tuiqereqere emphasized that Madigibuli must provide new evidence or grounds if he hopes to be granted bail; otherwise, he will remain incarcerated.
This latest application marks Madigibuli’s fourth attempt to secure bail after being charged with the fatal stabbing of his wife, Kitiana Baravilala, on April 25 of last year. As the trial is set to begin in April 2025, Justice Tuiqereqere considered any additional arguments presented by Madigibuli for his continued requests for bail.
The prosecution has been granted 14 days to respond to this recent application. In prior requests, Madigibuli argued that he needed access to the internet and communication devices for his defense, along with claims that employment was essential to support his children and afford legal representation. These claims have consistently faced staunch opposition from the State, which maintains that Madigibuli poses a significant risk to both the community and the victim’s family.
Concerns raised in previous court decisions regarding Madigibuli’s bail included the potential for him to compromise witness safety and the strength of the prosecution’s case against him, especially given his history of prior convictions and recent re-offense post-release. Justice Tuiqereqere reiterated the importance of ensuring community safety, characterizing Madigibuli as a considerable threat.
The next hearing for Madigibuli’s bail application is scheduled for November 14, where further arguments will be examined. This case highlights the delicate balance the justice system must maintain between safeguarding individual rights and addressing the safety needs of the community. The outcome will significantly impact not only Madigibuli but also the broader judicial commitment to uphold public safety amid serious allegations.
