Justice Dane Tuiqereqere has issued a stern warning to Apisai Madigibuli, a man accused of murdering his pregnant wife, regarding his ongoing bail requests. During a recent hearing at the High Court in Suva on October 22, Justice Tuiqereqere stated that unless Madigibuli presents new grounds for his bail application, he will remain in custody.
Madigibuli has attempted to secure bail multiple times, with this latest attempt being his fourth. He is charged with the fatal stabbing of his wife, Kitiana Baravilala, who was pregnant, on April 25 last year. As the court prepares for trial, set to commence in April 2025, Justice Tuiqereqere reviewed whether there were any additional arguments from Madigibuli that warranted consideration for bail.
The prosecution has been allotted 14 days to respond to this latest application. In previous attempts, Madigibuli sought bail under the premise that he needed access to the internet and communication devices to prepare his defense, alongside claims that working was necessary to support his children and hire legal representation. However, these requests have consistently faced strong opposition from the State, which argues that Madigibuli poses a considerable risk to the community and the family of the victim.
Past court rulings regarding Madigibuli’s bail have highlighted concerns over his potential to disrupt witness safety and the strength of the prosecution’s case against him, given his prior convictions and recent re-offense after being released from prison. Justice Tuiqereqere noted that Madigibuli remains a significant threat, and the community’s safety must be prioritized.
Madigibuli’s next bail application hearing is scheduled for November 14, where further arguments will be presented. This case serves as a reminder of the ongoing challenges within the justice system, balancing individual rights with the safety concerns of the community. The outcome will not only impact Madigibuli’s situation but also reflects the judicial commitment to ensuring community safety in light of serious allegations.
