The Judicial Services Commission (JSC) is refraining from making any public statements regarding the appointment of Acting Fiji Independent Commission Against Corruption Commissioner Lavi Rokoika, as the legality of the appointment is currently under judicial review in the High Court. Commission Secretary Tomasi Bainivalu emphasized that discussing the matter publicly could potentially disrupt the judicial process and compromise the integrity of the ongoing proceedings.
In his statement, Bainivalu clarified that the JSC will not participate in media debates regarding the legal challenges. He highlighted the Commission’s constitutional duty to make recommendations to the President, in consultation with the Attorney-General, adhering strictly to the law. Bainivalu also pointed out that public trust in the judiciary is bolstered when courts are permitted to make independent decisions free from outside influences.
Reiterating the Commission’s commitment, he assured that they will continue to fulfill their responsibilities with fairness, integrity, and independence. This approach reflects a dedication to upholding the rule of law and reinforces the importance of an unbiased judicial system, which ultimately serves the interest of justice in Fiji.
