A foster care advocate is disputing Congresswoman Nancy Mace’s description of an encounter at the Capitol, where Mace claimed she was “physically accosted” by a man who was subsequently arrested. Elliott Hinkle, a child welfare and LGBTQ youth advocate as well as founder of Unicorn Solutions, stated that Mace was speaking at an event celebrating the 25th anniversary of the Foster Care Independence Act when James McIntyre approached her. Hinkle described how after Mace’s remarks, McIntyre extended his hand, saying, “Trans youth are also foster youth, and they need your support,” before sitting back down.

Following this interaction, Hinkle noted that Mace appeared only slightly surprised and left the room alongside a congressional staffer, who later returned to inquire about McIntyre’s name and message. Shortly afterward, U.S. Capitol Police arrived and arrested McIntyre based on an investigative interview.

Hinkle observed the encounter, clarifying that it was a straightforward advocacy exchange rather than an aggressive confrontation, while another advocate, Lisa Dickson, expressed her disappointment over McIntyre’s arrest for a seemingly benign interaction. Mace has since claimed that McIntyre aggressively shook her arm, leaving her feeling intimidated and causing physical discomfort, although she declined medical assistance afterward.

In the midst of the fallout, Mace has maintained her stance on the incident, which she labeled as an assault, while also promoting a controversial measure to restrict lawmakers from using facilities that do not match their biological sex.

McIntyre, who was charged with assaulting a government official, appeared in court and pleaded not guilty. A judge has ordered him to maintain distance from Mace while releasing him with conditions.
