Former Fiji PM Bainimarama Convicted in Police Demands Case

Former Fiji PM Bainimarama Found Guilty of Unlawful Pressure on Acting Police Commissioner

Former Prime Minister Voreqe Bainimarama has been found guilty by the Suva High Court for exerting unlawful pressure on then Acting Police Commissioner Rusiate Tudravu. The court’s judgment revealed that between May 21 and August 18, 2021, Bainimarama coerced Tudravu to dismiss two police officers—Sergeant Penieli Ratei and Police Constable Tomasi Naulu—threatening him with dismissal should he refuse.

Justice Thushara Rajasinghe, who presided over the trial, affirmed that the prosecution presented sufficient evidence to demonstrate that Bainimarama’s demands were made under duress. During the proceedings, both Bainimarama and Tudravu confirmed their discussions regarding a controversial photograph of Bainimarama’s late brother, Jonacani Bainimarama, which had been circulated among police officers. The court noted that the officers’ actions in capturing and disseminating the photograph infringed on Bainimarama’s rights.

Justice Rajasinghe pointed out that as Prime Minister, Bainimarama lacked legitimate authority to influence decisions made by the Acting Commissioner of Police. In a significant turn of events, co-accused Qiliho was acquitted, with the court concluding that there was inadequate evidence to support claims of his abuse of power when he overturned Tudravu’s disciplinary actions regarding Ratei and Naulu.

The case has ignited vital discussions concerning government accountability and the ethical obligations of officials. As the legal proceedings move towards the next phase of mitigation and sentencing, there is heightened anticipation for a resolution that underscores transparency. The Office of the Director of Public Prosecution is expected to make a timely decision on whether to challenge Qiliho’s acquittal.

These developments are seen as steps toward enhanced accountability in Fiji’s governance, fostering public trust in the integrity and ethical practices of governmental institutions. The ongoing court process is positioned to play a significant role in navigating the dynamics between political power and the autonomy of law enforcement in Fiji.
