Fireworks Sparks Legal Battle: SeaWorld Faces Environmental Lawsuit

Two environmental organizations, San Diego Coastkeeper and Coastal Environmental Rights Foundation, are taking legal action against SeaWorld San Diego for purported violations of its Clean Water Act permits. The lawsuit, filed on March 6, claims that the park has failed to adhere to its permits, resulting in the discharge of pollutants into Mission Bay during its nightly fireworks displays.

The groups contend that SeaWorld has not followed necessary cleanup protocols, suggesting that debris and chemicals from the fireworks are contaminating the bay. They highlight concerns about hazardous materials, such as barium and strontium, which are found in fireworks and can be harmful to marine life, including fish and invertebrates. Additionally, the lawsuit points to the presence of debris like plastic shell casings and cardboard that negatively impact the ecosystem.

Phillip Musegaas, executive director of San Diego Coastkeeper, criticized SeaWorld for what he called a “reckless disregard” for its environmental responsibilities, emphasizing the potential risk to both public health and local wildlife. He confirmed that the groups had previously issued a Notice of Intent to sue in November, allowing SeaWorld 60 days to address their concerns, which they claim went unheeded, prompting further legal action.

While the environmental groups advocate for fireworks to continue, they stress the importance of ensuring these displays do not compromise water quality. Coastkeeper is not opposing the tradition of fireworks but is urging SeaWorld to implement responsible cleanup measures and comply with applicable regulations.

This case reflects broader concerns about environmental protection and the need for businesses to reconcile entertainment practices with ecological responsibility. The ongoing debate underscores the significance of maintaining clean water and safeguarding local ecosystems while enjoying community traditions like fireworks displays.
