Fiji’s Ex-PM Bainimarama Seeks Leniency in Landmark Public-Official Case

Former Prime Minister Voreqe Bainimarama’s legal saga continues as his attorney, Devanesh Sharma, recently urged the High Court in Suva to impose a more lenient sentence than a custodial one. Bainimarama was convicted earlier this month of making an unwarranted demand towards the then acting Police Commissioner, Rusiate Tudravu, between May and August 2021. His lawyer argued for alternatives such as community service, a fine, or a three-year suspended sentence, asserting that the 71-year-old former leader now poses no threat to society as he has retired and relies on his pension.

Sharma emphasized Bainimarama’s commitment to rehabilitation, citing that he completed a previous sentence through community work and was released for good behavior. However, the State opposed the leniency request. Laisani Tabuakuro, Assistant Director of Public Prosecutions, stressed that Bainimarama’s actions as a former prime minister were serious and warrant a custodial sentence, arguing that his level of culpability was high given his position of authority.

This case is significant as it marks the first prosecution in Fiji under the law concerning “unwarranted demands on a public official.” Bainimarama’s conviction follows a controversial incident involving the dismissal of two police officers who shared images of the former prime minister’s brother on a police chat group. Although Bainimarama was found guilty by Justice Thushara Rajasinghe, his co-accused, former police commissioner Sitiveni Qiliho, was acquitted of abuse of office.

The court is expected to deliver a verdict on Bainimarama’s sentencing on Wednesday next week, adding another chapter to this evolving legal situation.
