Fiji Targets Drug Trafficking Finances with Proceeds of Crime Act Forfeiture

The Office of the Director of Public Prosecutions (ODPP) has recently undertaken a pivotal legal maneuver aimed at dismantling the financial underpinnings of criminal networks involved in drug-related activities. In a noteworthy stride forward, the ODPP has secured a restraining order and a forfeiture order for assets linked to the case of State versus Alzaid Ali and Grace Katia Luivoliga in the Lautoka High Court, who are charged with drug offenses.

Invoking the Proceeds of Crime Act, particularly sections 19C to 19E, the ODPP has leveraged a non-conviction-based civil forfeiture mechanism. This legal framework allows for the confiscation of assets tied to criminal activities without needing a preceding criminal conviction. Consequently, the Lautoka High Court granted approval for the forfeiture of a white Honda Fit Shuttle, a black Audi, substantial amounts of money in the accused’s Westpac accounts, and cash found at the time of Ali’s arrest.

This legal approach underscores a tactical shift towards attacking the financial assets that sustain criminal activities. By financially incapacitating those engaged in illicit dealings, the ODPP aims to deliver a substantial blow to these networks.
