The Fiji Council of Social Services (FCOSS) has expressed approval of Prime Minister Sitiveni Rabuka’s decision to refrain from appealing the High Court’s ruling on the unlawful dismissal of former Fiji Independent Commission Against Corruption (FICAC) Commissioner Barbara Malimali. President Sepesa Rasili welcomed the Prime Minister’s judgment as a prudent measure, emphasizing that accountability is vital to the foundation of Fiji’s democracy.

In a statement released on Thursday, the government indicated that after seeking legal advice and engaging in consultations, both the President and the Government decided against challenging the ruling. Rasili highlighted the importance of adhering to established legal protocols, stating that such adherence is non-negotiable.

He further urged that the Prime Minister must be supported by advisors who uphold the law and prioritize human rights, rather than succumbing to misguided popular opinions. Rasili affirmed that all decisions made must protect the rule of law and serve the public interest.

The High Court’s ruling determined that the Judicial Services Commission (JSC), rather than the Prime Minister, holds the legal authority to advise the President on matters pertaining to the FICAC Commissioner’s appointment or dismissal. Following this decision, the JSC convened on Thursday and announced its commitment to collaborating with Acting Attorney-General Siromi Turaga to provide independent recommendations to the President regarding Malimali by March 31.

However, Rasili also expressed deep concern over whistleblower allegations linked to the Fiji Sports Council and the Minister of Youth and Sports. He pointed out a growing public distrust in institutions such as FICAC, asserting the urgency to restore that confidence. He called for all individuals involved in these allegations to step down immediately and stressed that a thorough, independent investigation into the Fiji Sports Council, the Ministry of Youth and Sports, FICAC, and the Prime Minister’s Office is essential.

Rasili acknowledged the frustrations felt by many citizens and urged them to direct that energy toward constructive actions that will fortify the nation’s democratic institutions and processes.
