The Fiji Independent Commission Against Corruption (FICAC) has submitted an amended charge against lawyer Tanya Waqanika during a legal proceeding this morning. Ms. Waqanika appeared before Magistrate Yogesh Prasad at the Suva Magistrate’s Court, where she confronted accusations of publicly opposing a political party. This allegation arises from the Political Parties (Registration, Conduct, Funding and Disclosures) Act 2013, specifically citing section 14 (7) in conjunction with section 14 (1) (d).
The charges suggest that on April 19 of the previous year, Ms. Waqanika, who serves as a board member for Investment Fiji and Telecom Fiji Ltd, made remarks on her Facebook page that were critical of the Social Democratic Liberal Party (SODELPA). Such actions are claimed to violate regulations that govern the conduct of public officials.
The charge was recently amended only to correct the spelling of Ms. Waqanika’s name. During the court session, Rusiate Doidoi represented the prosecution while Barbara Malimali acted on behalf of the defense. Following the hearing, Ms. Waqanika’s bail conditions were extended.
This ongoing case illustrates the critical balance that must be maintained regarding the compliance of public officials with political conduct regulations, shedding light on the broader scrutiny of political discourse within Fiji. As the proceedings continue, it remains crucial to observe how the legal framework addresses the delicate relationship between free speech and political expression, potentially influencing future discussions around political freedoms in the country.
