A landlord has received a suspended sentence from the Nasinu Magistrates Court after being convicted of failing to maintain proper records and provide necessary information, in violation of the Commerce Commission’s Rent Increase Restriction on Residential and Ground Rent Orders 2016 and 2017.

During the trial, the court observed a notable absence of genuine remorse from the offender. Although the sentencing took into account the individual’s personal circumstances, the court underscored the importance of accountability and the need to deter similar violations. The Resident Magistrate recorded a conviction on both counts, resulting in an aggregate sentence of one year and two months’ imprisonment, which is suspended for a period of two years.

Senikavika Jiuta, Chief Executive of the Fijian Competition and Consumer Commission (FCCC), praised the court’s decision, highlighting that the FCCC Act is designed to protect the integrity of landlord and tenant relationships. “It is a strict legal requirement for landlords to maintain proper records and to provide information to the regulator when requested. This case serves as a firm reminder to all landlords that neglecting these lawful duties has serious legal consequences,” Jiuta stated.

She reaffirmed the FCCC’s commitment to promoting transparency within the rental market and taking strong action against those who violate consumer protection laws by failing to adhere to reporting and record-keeping requirements. The FCCC encourages landlords to ensure their documentation is accurate, current, and compliant with legal obligations. Additionally, consumers are urged to report any irregularities in their rental agreements or potential breaches of the rent-freeze order.

This case underscores the importance of compliance within the real estate sector and serves as an assurance to tenants that regulatory bodies are vigilant against neglectful practices in the rental market.
