The Judicial Services Commission (JSC) of Fiji has reiterated its commitment to uphold its constitutional duties and to respect the nation’s court system. The Commission has decided to refrain from making public comments regarding the appointment of Lavi Rokoika as Acting Commissioner of the Fiji Independent Commission Against Corruption (FICAC) while the matter is under judicial review.
In a recent statement, the JSC acknowledged the growing public discourse and media inquiries about Rokoika’s appointment but emphasized that this issue is currently being addressed in the High Court of Fiji. Tomasi Bainivalu, the Secretary to the JSC, noted, “The legality of Ms. Rokoika’s appointment is presently before the High Court,” highlighting the potential consequences of public commentary during ongoing legal proceedings.
Bainivalu added that any defensiveness or justification from the JSC at this time could interfere with justice, stating, “The JSC will not compromise the integrity of the judicial process.” He also clarified that the Commission’s roles are clearly outlined in the Constitution, indicating that the JSC’s primary responsibility is to make recommendations to the President of Fiji after consulting the Attorney General, rather than to engage in public debates or adjudicating legal matters through media platforms.
