The High Court of Fiji has delivered a significant ruling, imposing a two-year prison sentence, wholly suspended for a period of five years, on a juvenile found guilty of various sexual offences against two children. The ruling was made in Lautoka and concerns a case involving a defendant, referred to as O.V. due to legal suppression orders, who was convicted of one count of indecent assault, one count of sexual assault, and three counts of rape, all involving victims below the age of 13.

The offences took place in 2022 when the offender was just 16 years old, with the victims being eight and eleven years old at the time. The court revealed that the offender was related to both victims and resided with one of them, highlighting the abuse of trust that occurred within a family environment.

During the trial, evidence presented illustrated multiple incidents of sexual abuse occurring at a family home, supported by medical examinations that confirmed injuries consistent with sexual penetration. When determining the sentence, the court identified several aggravating factors, including the youth of the victims, the inherent trust violated by the offender in a familial context, and the overall vulnerability of the children affected.

Despite these aggravating circumstances, the court also considered mitigating factors. These included the offender’s young age, a clean criminal record prior to this case, cooperation with law enforcement, and expressions of remorse regarding the actions committed.

The judge noted that according to the Juveniles Act, penalties for young offenders are limited to a maximum of two years of imprisonment. Considering this, the court decided on a cumulative sentence of two years but suspended the term for five years. Additionally, a permanent Domestic Violence Restraining Order was issued, preventing any further contact between the offender and the victims.

This case highlights the delicate balance that the judicial system must navigate in handling juvenile offenders while prioritizing the protection and justice for vulnerable victims. The hope remains that appropriate interventions and support can lead to positive outcomes for all parties involved.
