Fiji High Court Sets Stage for No-Case Submission in Sayed-Khaiyum-Saneem Case

The Suva High Court is currently addressing submissions in the legal proceedings involving former Attorney General Aiyaz Sayed-Khaiyum and former Supervisor of Elections Mohammed Saneem. Following the conclusion of the prosecution’s arguments, the defense is now presenting a no case to answer submission, scheduled to be filed by 9 am tomorrow. The court will resume the hearing at 2:30 pm thereafter.

Both Sayed-Khaiyum and Saneem have pleaded not guilty to the charges brought against them. The prosecution, represented by State Counsel Nancy Tikoisuva, recently made amendments to clarify the first two charges. The allegations against Sayed-Khaiyum involve abuse of office, as he is accused of acting inappropriately in his capacity as Prime Minister and Chair of the Constitutional Offices Commission in 2022. Specifically, it is claimed he facilitated a Deed of Variation and Addendum, improperly approving tax waivers for Saneem without the necessary authorization.

Saneem faces charges related to receiving undue benefits, with accusations of procuring tax relief worth $55,944.03 on his back pay through Sayed-Khaiyum.

The case, which has experienced delays due to a magistrates’ conference and health-related exemptions for Sayed-Khaiyum, underscores the complex legal scrutiny surrounding the actions of high-profile government officials. As proceedings continue, the judiciary remains diligent in ensuring a thorough review of the charges and submissions. This case is being observed closely by various stakeholders, as its outcome could have significant implications for accountability and governance standards.
