Fiji Court Delays Ruling in Bainimarama-Qiliho Case Amid Constitutional Submissions

Fiji High Court Delays Verdict in Bainimarama and Qiliho Case, Sets New Date

The Suva High Court has delayed its judgment in the high-profile case involving former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho, setting the new date for the verdict to next Thursday. Justice Thushara Rajasinghe has asked for additional submissions addressing specific constitutional sections related to appointing an acting Police Commissioner, particularly sections 163(2), 135(4), and 129(4).

Bainimarama is facing a charge of making unwarranted demands as a public official. He allegedly pressured Acting Commissioner of Police, Rusiate Tudravu, to dismiss Sergeant Penieli Ratei and Police Constable Tomasi Naulu, under the threat of affecting his own professional standing. Sitiveni Qiliho, on the other hand, is charged with two counts of abuse of office, accused of bypassing the proper procedures in August 2021 to order the termination of the same officers, thus infringing on their rights.

This case has garnered significant public interest, highlighting crucial discussions around governance and accountability standards for public officials in Fiji. It emphasizes the judiciary’s critical role in addressing misconduct and upholding the integrity of government institutions. The defense team, led by R. Patel Lawyers Devanesh Sharma and Gul Fatima, alongside prosecution attorneys Assistant DPP Laisani Tabukuro and Pooja Mishra, underscores the seriousness and implications of the charges.

Beyond the legal intricacies, this case represents a pivotal moment for reinforcing ethical standards and transparency within Fiji’s public sector. It is hoped that the proceedings will bolster accountability and ensure justice and fairness, potentially paving the way for a stronger governance framework. As public dialogue continues, there is optimism that the ruling will inspire more rigorous ethical standards, thereby enhancing public trust in government institutions.
