The Fijian Competition and Consumer Commission (FCCC) has issued a stern warning to maritime operators, vessel owners, agents, and port-based businesses, emphasizing that obstructing FCCC officers during the execution of their duties is illegal and will not be tolerated. The Commission made it clear that no operator has the authority to hinder authorized FCCC personnel in their mandated role of safeguarding passengers against unethical practices such as overcharging and unfair treatment.

With maritime travel expected to surge during the festive season, FCCC officers have been strategically stationed at major wharves and ports throughout the Central and Northern Divisions. For the first time, the Commission has also introduced shift-based enforcement operations at these locations, allowing officers to work extended hours to ensure continuous oversight during peak travel times.

According to the FCCC (Control of Maritime Shipping Services, Freight Rates and Passenger Fares) Order 2022, all maritime shipping services, freight rates, and passenger fares in Fiji are regulated prices that the FCCC is obligated to fix, monitor, and enforce. This regulation also grants FCCC officers the authority to board vessels to ensure compliance with established guidelines.

Furthermore, Section 126 of the FCCC Act empowers authorized officers to enter premises, including ports, vessels, and offices, during reasonable hours to gather information and verify compliance. Section 128 stipulates that it is an offense to obstruct, hinder, or interfere with an officer.

The FCCC stated, “Any obstruction will be dealt with in accordance with the law, which includes taking statements and pursuing charges where necessary.”During the festive season, the FCCC will closely evaluate passenger fares, freight charges, pricing displays, adherence to pricing directives, and the behavior of operators towards officers.

Passengers who encounter issues such as overcharging or unfair treatment are urged to report these incidents to the FCCC immediately, as the Commission is resolutely committed to enforcing consumer protection in Fiji’s maritime sector. This proactive approach aims to ensure a fair and enjoyable travel experience for all passengers during this busy time of year.
