The Fijian Competition and Consumer Commission (FCCC) has issued a strong warning to maritime operators, vessel owners, agents, and port-based businesses, underscoring that obstructing FCCC officers while they carry out their duties is illegal and will not be tolerated. The Commission has made it explicit that no operator is authorized to impede FCCC personnel in their critical role of protecting passengers from unethical practices such as overcharging and unfair treatment.
As maritime travel is anticipated to increase during the festive season, FCCC officers have been deployed strategic positions at major wharves and ports across the Central and Northern Divisions. In a new approach, the Commission is implementing shift-based enforcement operations, which will allow officers to work longer hours to maintain continuous oversight during peak travel periods.
The FCCC (Control of Maritime Shipping Services, Freight Rates, and Passenger Fares) Order 2022 establishes that all maritime shipping services, freight rates, and passenger fares are regulated prices within Fiji, which the FCCC must fix, monitor, and enforce. This regulation empowers FCCC officers to board vessels in order to ensure compliance with the outlined guidelines.
Additionally, Section 126 of the FCCC Act permits authorized officers to access premises, including ports, vessels, and offices, during reasonable hours to gather information and confirm compliance. Section 128 further indicates that obstructing or hindering an officer is a criminal offense.
The FCCC emphasized, “Any obstruction will be addressed according to the law, which includes taking statements and pursuing legal charges if necessary.” Throughout the festive season, the Commission plans to closely monitor passenger fares, freight charges, pricing displays, compliance with pricing directives, and the interactions between operators and FCCC officers.
Passengers facing issues such as overcharging or unfair treatment are encouraged to report these situations to the FCCC immediately. The Commission is firmly dedicated to enforcing consumer protection within Fiji’s maritime sector, demonstrating its commitment to ensuring a fair and pleasant travel experience for all passengers during this busy time of year.
