Fiji Court Delays Verdict as Appointment Powers for Acting Police Commissioner Come Under Scrutiny

Fiji Court Delays Judgment Amid Debate Over Acting Police Commissioner Powers

The Suva High Court has delayed the judgment for former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho. Justice Thushara Rajasinghe has requested additional legal submissions from both the prosecution and defense teams, focusing on the interpretation of laws concerning the appointment powers of Acting Police Commissioners. This is to determine whether such authority is exclusively held by the Constitutional Offices Commission or can be delegated by an officer.

The new deadline for these submissions is next Tuesday, with the final judgment expected the following Thursday. Bainimarama and Qiliho face charges related to unwarranted demands and abuse of office, which date back to 2021. The charges deal with their alleged involvement in the employment termination of Sergeant Penieli Ratei and Constable Tomasi Naulu. Bainimarama is accused of using his influence to have the officers dismissed, while Qiliho is alleged to have misused his power by overturning a disciplinary decision and choosing termination instead.

This trial has gained considerable public attention due to its implications on governance, ethical conduct, and accountability within Fiji. The proceedings could have significant repercussions on the enforcement of transparency and justice in the nation’s government institutions. As the case unfolds, it serves as a pivotal moment for reinforcing ethical standards and promoting more transparent governance practices, offering a hopeful vision for the future of Fiji’s public service.
