Senior lawyer Joji Cakau is preparing to challenge the bail decision for his client, Eroni Kitanamati, who is accused of importing 4.7 kilograms of liquid methamphetamine. Kitanamati, 37, faced Chief Magistrate Josaia Waqaivolavola at the Suva Magistrates Court on September 16, where he was informed that his initial bail application had been denied. This case is notable as it is connected to a larger investigation involving two police officers, aged 43 and 31, who are also facing similar charges.
During the proceedings, Magistrate Waqaivolavola pointed out that he could not locate Kitanamati’s formal bail application or notice of motion. In reaction, Cakau submitted an affidavit on behalf of his client, but was reminded by the magistrate that affidavits must be substantiated with evidence, rather than reliant on legal arguments. Prosecutor Unal Lal stressed the necessity of a notice of motion for the bail review under the Bail Act, pointing out that Kitanamati’s previous bail application was rejected by Magistrate Charles Ratakele, who had to recuse himself from the case due to a family affiliation with the accused.
The prosecutor further underscored that a plea for a review must show evidence of changed circumstances. Magistrate Waqaivolavola subsequently established a timeline, requiring the defense to submit their application by October 22, with the prosecution tasked with responding by October 24. A hearing for the bail review has been scheduled for October 27.
