Senior lawyer Joji Cakau is preparing to file a review of the bail application for his client Eroni Kitanamati, a 37-year-old man accused of importing 4.7 kilograms of liquid methamphetamine. Kitanamati appeared in the Suva Magistrates Court before Chief Magistrate Josaia Waqaivolavola on September 16. The alleged offense occurred between September 11 and 12 and is linked to a broader case that has already implicated two police officers, aged 43 and 31, who face similar charges.
During the court proceedings, Magistrate Waqaivolavola noted that he could not find Kitanamati’s notice of motion or formal bail application. In response, Mr. Cakau filed an affidavit on behalf of his client, but the magistrate reminded him that affidavits must be grounded in evidence rather than legal arguments. Prosecutor Unal Lal explained that a notice of motion for bail review is required under the Bail Act, asserting that Kitanamati’s initial bail application was denied by Magistrate Charles Ratakele, who recused himself due to a familial connection with the accused.
The prosecutor emphasized that any request for a review must demonstrate a change in circumstances. Following this, Magistrate Waqaivolavola set a timeline for the defense to submit its application by October 22, with the prosecution expected to respond by October 24. A bail review hearing is scheduled for October 27.
