The Suva Magistrates Court is set to determine the fate of three Chinese nationals, Yu Yuan Feng, Dai Ming Hui, and Zhou Lan, charged with drug offenses, during a bail review slated for later this month. Their case was heard before Magistrate Vinaina Diroiroi, who proceeded with the session despite the absence of a translator, as defense counsel opted to continue without one.
The defense team articulated that there are strong grounds for the trio’s release on bail, highlighting the recent vacating of their trial and the failure of the State to consolidate related charges. Each defendant has secured two sureties and expressed readiness to post a $2,000 cash bond.
Critically, the defense maintained that the accused have no prior convictions and pose no flight risks. They have surrendered their passports, agreed to comply with stop-departure notices, and are willing to report to the Totogo Police Station on a weekly basis. Additionally, the defendants’ visas are set to expire in January, and holding them in remand could hinder their ability to maintain lawful status.
However, the State has voiced opposition to the bail request. Affidavits and a memorandum from the Ministry of Immigration were presented, indicating that if bail were granted, the accused might be remanded again upon the expiration of their visas. The prosecution also intends to file for the consolidation of charges against the defendants.
The defense criticized the State’s approach, claiming that delays in formalizing charges deprive their clients of timely justice. The court has scheduled to revisit this matter on November 25.
