Ferrari’s Fight: Court Upholds Controversial Race Decision

The International Court of Appeal held a hearing on September 3, 2024, in Geneva regarding an appeal filed by Ferrari AF Corse. This appeal was against Decision No. 80, made by the Stewards of the 6 Hours of Spa-Francorchamps, a race in the 2024 FIA World Endurance Championship held on May 12, 2024.

During the race on May 11, a red flag was shown at 17:13 due to an incident, leading to a suspension. The Stewards announced a decision at 18:49 to resume the race at 19:10 for an additional hour and 44 minutes, in line with Article 14.3.1 of the 2024 WEC Sporting Regulations.

After the race, Ferrari AF Corse filed a protest against this decision and the subsequent provisional classification. Following a hearing, the Stewards issued Decision No. 80 at 00:12 on May 12, rejecting Ferrari’s protest, stating that such decisions cannot be contested under Article 13.2.1 of the FIA International Sporting Code. The final classification was then confirmed shortly afterward.

On May 15, Ferrari AF Corse appealed Decision No. 80 to the International Court of Appeal. Following the examination of the case and submissions from both sides, the Court upheld the Stewards’ Decision No. 80.

Mr. Nish Shetty from Singapore presided over the International Court of Appeal, which included members from Spain, Slovakia, and Austria.
