The Lautoka High Court has found a former Police Constable guilty of several serious offenses, including indecent assault, sexual assault, and three counts of rape. Justice Aruna Aluthge delivered the ruling following the circumstances surrounding the incident, which occurred on September 3, 2023.
Testimonies revealed that the complainant, a female colleague, had been socializing over drinks with the defendant and another officer. After stepping away to visit another colleague, she returned to find the accused encouraging her to enter his room under the guise of fetching an item. Once inside, he locked the door and proceeded to commit the crimes against her.
Throughout the trial, the defendant maintained that he believed the complainant had consented since she did not scream, protest, or resist. However, Justice Aluthge stressed that it is the prosecution’s responsibility to prove the absence of consent, which they did successfully beyond a reasonable doubt.
The court dismissed the defendant’s claims and established that both the intent to commit the offenses and the lack of consent were clearly present.
