A foster care advocate is contesting Congresswoman Nancy Mace’s assertion that she was “physically accosted” by James McIntyre, a man arrested at the Capitol. Elliott Hinkle, founder of Unicorn Solutions and an advocate for child welfare and LGBTQ youth, attended an event marking the 25th anniversary of the Foster Care Independence Act. During the event, Hinkle noted that Mace spoke favorably of working with advocates present. After her speech, McIntyre approached Mace, extended his hand, and expressed the need for support for transgender youth who are also in foster care.
Hinkle described this encounter as benign, stating, “I watched that interaction happen, and I saw a handshake and a conversation,” asserting it was a regular exchange during advocacy efforts. Following this interaction, a congressional staffer returned to inquire about McIntyre’s message for Mace, leading to the arrival of U.S. Capitol Police who later arrested McIntyre during an investigative interview.
Expressing her discontent, Lisa Dickson, another former foster youth advocate, criticized Mace on social media for creating a supposed “safe space” for foster youths, yet allowing one of them to be arrested for merely advocating for trans rights.
Mace’s account of the incident, detailed in a report filed with D.C. Superior Court, claims McIntyre aggressively shook her arm, leaving her feeling intimidated. Following the incident, she reported pain but declined medical assistance. On social media, Mace described her ordeal, labeling McIntyre as a “pro-trans man.”
Meanwhile, Mace recently introduced a measure aimed at restricting lawmakers and House employees from using facilities that do not correspond to their biological sex, following the election of Sarah McBride, the first openly transgender member of Congress.
Capitol Police stated McIntyre was charged with assault and he remained in custody overnight before being released. Following his release, McIntyre maintained his innocence through a court-appointed attorney. A magistrate has mandated that he stay away from Mace as part of his release conditions.
