In a significant development concerning the tragic death of Texas A&M student Brianna Aguilera, attorney Tony Buzbee announced at a news conference that he represents Brianna’s parents in a lawsuit alleging that she was overserved alcohol before her fatal fall from the 17th floor of an Austin apartment. The incident occurred after tailgating for a Texas A&M-Texas football game in November 2025.

Buzbee filed the lawsuit against the Austin Blacks Rugby and the UT Latin Economics and Business Association, claiming that Brianna, who was a minor, as well as other minors at the event, were served excessive amounts of alcohol. This allegation highlights the concerns over the responsibility of organizations that host tailgating events.

The attorney asserted that through this legal action, they aim to hold those responsible accountable and will utilize the lawsuit to subpoena documents, video footage, and potential witnesses as they continue their investigation. Buzbee criticized the Austin Police Department’s investigation, claiming it was incomplete and pointing out that a witness, Dannah Rodriguez, who lived across the hall from the apartment, was never interviewed despite having valuable information about the events surrounding Brianna’s death.

Dannah Rodriguez reported hearing loud music, arguing, and screaming that night, leading her to believe a party was taking place. She noticed the chaos peaking around the time of Brianna’s fall, expressing her hope that her testimony could aid the investigation and conveying her sympathies to Brianna’s family.

Brianna’s mother, Stephanie Rodriguez, has publicly rejected police conclusions suggesting her daughter’s death was a suicide. She has called for a second autopsy and a fresh investigation, believing that the circumstances of Brianna’s death require a more thorough examination. Buzbee has echoed these sentiments, criticizing the police for what he termed a rushed judgment.

Austin police stated that they believe evidence indicates that Aguilera took her own life, and they have an ongoing active investigation into the matter. They also confirmed that a deleted note, purportedly a suicide note, was found on her phone.
