After extensive discussions, the Judicial Services Commission (JSC) has announced plans to invite former FICAC Commissioner Barbara Malimali, her legal counsel, the Solicitor General, and the Prime Minister’s advisor for consultations regarding the enforcement of the High Court’s recent orders.
The High Court determined that the JSC holds the exclusive authority to advise the President on the appointment or removal of the FICAC Commissioner, a ruling that clearly delineates the roles of various governmental entities. This decision asserts that the Prime Minister does not possess this legal power, emphasizing the significance of the JSC’s independence in such matters.
Following these important consultations, the JSC plans to collaborate with Acting Attorney-General Siromi Turaga to formulate independent recommendations for the President. The JSC has expressed its intention to expedite the process, aiming to resolve the Malimali situation by March 31st.
