Google and Apple have recently advised their US-based employees on work visas to refrain from international travel after their legal counsel alerted them to significant delays at US embassies and consulates. Reports indicate that these delays could extend as long as 12 months amidst ongoing immigration scrutiny.
In a memo shared on Thursday, BAL Immigration Law, which represents Google, warned employees about the current visa appointment delays, stating, “Please be aware that some US Embassies and Consulates are experiencing significant visa stamping appointment delays, currently reported as up to 12 months.” The memo further cautioned that traveling without a valid visa stamp could result in an extended stay outside the US.
Similarly, Apple’s legal representatives at Fragomen issued a notification urging caution for employees lacking a valid H-1B visa stamp. They emphasized the importance of consulting with Apple Immigration and Fragomen before making any travel plans, focusing on the unpredictable delays that could arise upon attempting to return to the US.
These visa appointment delays have been observed globally, largely due to a new social media screening requirement which impacts H-1B visa holders and their dependents, as well as students and exchange visitors. A spokesperson for the Department of State confirmed that they are conducting online presence reviews for applicants and noted that appointment availability might shift depending on resource allocation. It was indicated that thorough vetting of each visa case has become a priority over processing speed.
Immigration firm Reddy Neumann Brown PC has also reported postponements of visa appointments in countries such as Ireland and Vietnam, highlighting the widespread nature of the delays. Google’s memo pointed out that various visa categories, including H-1B, H-4, F, J, and M, have been affected. However, neither company provided guidance for individuals who are already abroad and facing postponed visa appointments.
Amidst these challenges, a Department of State spokesperson reiterated the importance of demonstrating compliance with US visa requirements, noting that visas will only be granted when applicants credibly show that they meet all legal criteria.
The H-1B visa program is crucial for employers seeking skilled foreign workers, with Google’s parent company, Alphabet, applying for 5,537 H-1B visas during the 2024 fiscal year, while Apple applied for 3,880. Over recent years, the program has faced increased scrutiny, particularly under previous administrations, leading to changes that have made it more complex and costly for employers to navigate the hiring of overseas talent.
As these companies navigate the complexities of visa applications, it serves as a reminder of the ongoing challenges that employers and employees face in the rapidly evolving immigration landscape.
