Members of the Judicial Services Commission have gathered this afternoon in light of the recent High Court ruling concerning the dismissal of former FICAC Commissioner Barbara Malimali. The court determined that her removal was unlawful, as it ruled that the Prime Minister lacked the legal authority to advise the President to overturn her appointment.

Chief Justice Salesi Temo was observed arriving at the meeting, accompanied by other key figures including Permanent Secretary for Justice Selina Kuruleca, Vani Catanasiga, and JSC Secretary and Chief Registrar Tomasi Bainivalu.

Justice Dane Tuiqereqere emphasized that the authority to advise the President on such matters resides solely with the Judicial Services Commission. He also stated that issues related to Malimali’s reinstatement or potential damages are now within the jurisdiction of the JSC to decide.

The discussions are currently underway, with further developments anticipated in the near future. This case highlights the critical role of the judiciary in upholding constitutional processes and ensuring that legal frameworks are adhered to. The decision may pave the way for clearer guidelines regarding the appointment and removal of officials within governmental agencies, reinforcing the importance of lawful conduct in public service.
