The Judicial Services Commission (JSC) has announced its intention to invite former FICAC Commissioner Barbara Malimali, along with her legal counsel, the Solicitor General, and the Prime Minister’s advisor, for consultations regarding the enforcement of recent High Court orders. This significant move comes after the High Court ruled that the JSC exclusively possesses the authority to advise the President on the appointment or removal of the FICAC Commissioner, clarifying the roles of various governmental entities involved in the process.

The ruling underscores that the Prime Minister does not have the legal power to intervene in such appointments, highlighting the critical importance of the JSC’s independence in judicial matters.

In the wake of these consultations, the JSC aims to collaborate with Acting Attorney-General Siromi Turaga to develop independent recommendations for the President. The Commission has articulated its commitment to expediting this process, with the goal of resolving the situation surrounding Malimali by March 31st.

This proactive approach demonstrates the JSC’s dedication to upholding the rule of law and ensuring that due processes are respected in the management of judicial appointments. As various stakeholders convene to discuss the implications of the court ruling, there is a hopeful sentiment that a fair and just resolution will emerge in the near future. The ongoing commitment to transparency and adherence to judicial protocols bodes well for the integrity of the legal system.
