Fiji has recently implemented new regulations governing local government elections through the Electoral (Local Government Elections) Regulations 2025. This comprehensive framework aims to tackle electoral violations more effectively by enforcing stringent penalties not only for those who commit infractions but also for those who assist them.
According to these regulations, any individual involved in helping, advising, or facilitating breaches of electoral rules is considered personally responsible for the offence. Political parties are equally held accountable; if violations occur under the supervision of any party officials or executive bodies, the party can also face significant penalties.
The regulations categorize penalties into two distinct groups. Category A offences carry severe fines, including potential penalties of up to $50,000 for political parties, $10,000 for candidates and their polling agents, and $5,000 for other individuals. A notable consequence of a Category A violation is the disqualification from registering on the National Register of Voters for up to four years. In comparison, Category B offences attract lighter penalties, with fines capped at $1,000 for political parties, $500 for candidates, and $200 for individuals. Courts have the authority to convict for a Category B offence even if a person is initially charged with a Category A violation, depending on the situation’s specifics.
The definitions within the regulations are expansive, ensuring that “person” includes organizations and office holders as well. Political parties bear responsibility extending to registered officers and office bearers. Furthermore, for corporations and non-governmental organizations (NGOs), accountability extends to directors, senior officers, and board members, especially where executive decisions influence actions. Media entities are also included in this legal framework, holding directors, editors, and publishers liable for any electoral misconduct.
These enhanced electoral regulations signify a crucial move toward ensuring accountability and integrity within Fiji’s local government elections.
