A permanent stay application submitted by former finance minister Professor Biman Prasad was brought before the High Court for the first time yesterday. Justice Siainiu Fa’alogo Bull presided over the hearing and indicated that the substantive hearing could potentially be scheduled for March 18 and 19 of next year.

Professor Prasad’s legal representative, Richard Naidu, informed the court that his client intends to seek an interim stay while the permanent stay application is under consideration. Justice Bull noted the proposed hearing dates would be confirmed on January 15, coinciding with another related matter involving former trade minister Manoa Kamikamica.

The permanent stay application faced opposition from the Fiji Independent Commission Against Corruption (FICAC). However, Mr. Naidu emphasized that his client will pursue interim relief during the pending determination of the substantive application. Following the submissions, Justice Bull acknowledged the points raised and postponed the matter until January 15 for further mention, at which point the court is expected to finalize the hearing dates.

This case highlights ongoing legal challenges faced by prominent figures in governance and the judicial process involved in addressing such matters. It serves as a reminder of the complexities within public service leadership and the accountability mechanisms in place.
