The Suva Magistrates Court is preparing to make a significant decision regarding three Chinese nationals, Yu Yuan Feng, Dai Ming Hui, and Zhou Lan, who have been charged with drug offenses. The defense team has argued compellingly for the release of the accused on bail, pointing to the recent vacating of their trial and the State’s failure to consolidate related charges against them. They noted that each defendant is able to secure two sureties and has offered to provide a $2,000 cash bond. Importantly, the defense emphasized that none of the defendants have prior convictions or pose a flight risk. They have voluntarily surrendered their passports, accepted stop-departure notices, and committed to weekly reporting at the Totogo Police Station. With their visas expiring in January, the defense argued that detaining them could complicate their legal status.
In contrast, the State has opposed their bail application, presenting affidavits and a memorandum from the Ministry of Immigration. They raised concerns that if bail is granted, the accused might be further remanded once their visas expire. The prosecution also plans to seek the consolidation of charges against the defendants.
The defense has criticized the State’s position, claiming that the delays in formalizing charges are impeding their clients’ access to timely justice. The court is set to revisit this bail application on November 25.
