Niraj Surend Prasad has been ordered to stay in custody following his recent appearance in the Suva Magistrates Court, where he faces serious charges related to the theft of an ATM card belonging to 86-year-old Malakai Kauwale on January 5, 2026, in Suva.

During the court session, police prosecutor Sergeant Salote Bola emphasized the denial of bail, referencing Prasad’s prior two theft convictions along with an ongoing issue related to absconding bail. These factors played a significant role in the prosecution’s concerns about Prasad’s reliability in adhering to future bail conditions.

Presiding over the case, Magistrate Charles Ratakele acknowledged that Prasad opted to waive his right to legal representation. Consequently, Magistrate Ratakele remanded Prasad in custody and set a further hearing for January 12, where Prasad will have the chance to formally apply for bail. Until then, he will remain detained.

This case brings to light the persistent challenges faced by the legal system in dealing with theft and protecting vulnerable individuals, particularly the elderly. It stresses the importance of vigilance in safeguarding the rights and well-being of such populations against increasing opportunistic crimes. The situation serves as a reminder for the community and authorities to remain proactive in their efforts to prevent similar offenses.
