His attorneys filed a motion on January 6, advocating for a status hearing and contending that Durk’s extended isolation breaches federal regulations and may implicate the Eighth Amendment concerning cruel and unusual punishment.

According to his lawyer, Christy O’Connor, Durk has endured 131 consecutive days of solitary confinement. During this period, he has faced restrictions including a lack of access to the commissary, allowed only a single phone call each month, and an inability to receive in-person visits from friends or family. O’Connor highlighted the dire nature of Durk’s living conditions, which she described as a cramped jail cell containing only a single bed, toilet, and sink.
