The Judicial Services Commission (JSC) recently held a productive meeting with former FICAC Commissioner Barbara Malimali’s lawyer, Tanya Waqanika, to discuss the implications of a court order issued by Justice Dane Tuiqereqere. The meeting was convened to gather perspectives regarding the High Court’s directives, and all involved parties have agreed to reconvene on the 25th of next month for further discussions.

The JSC is scheduled to make its decision by March 31, 2026, demonstrating its commitment to upholding the rule of law, as well as maintaining its independence and integrity in decision-making processes. Waqanika expressed optimism about Malimali potentially returning to her role as FICAC Commissioner.

Earlier this month, Justice Tuiqereqere ruled that the Prime Minister lacked the legal authority to advise the President on revoking Malimali’s appointment. The judge highlighted that the JSC holds the exclusive power to advise the President and is not mandated to act on the findings and recommendations from the Commission of Inquiry (COI). He emphasized that the JSC must independently assess the relevance of COI evidence, findings, and recommendations concerning Malimali’s appointment.

This ongoing dialogue reflects a positive approach towards resolving the situation, with hopes for a fair and just outcome that aligns with judicial determinations. The JSC’s proactive stance reinforces the importance of judicial independence and transparency in governance.
