Former senior police officer Isoa Natui has been acquitted of all charges after the prosecution could not establish that his actions with unclaimed funds resulted in personal gain. His case stemmed from a charge laid by the Office of the Director of Public Prosecutions (ODPP), which accused him of abusing his office by unlawfully directing the release of $8,064.50 in cash that had been seized during a drug raid in 2020.
The seized money was designated as unclaimed and should have been deposited into the Government Revenue Account as per police standing orders. However, the funds were directed to Mr. Natui, who utilized them to acquire essential operational equipment for the Southern Division Crime Unit in Nabua. The items purchased included two binoculars, two Dell laptops, a printer, two hard drives, an extension cord, and a Wi-Fi device. All these items were logged into the inventory at the Nabua Police Station.
In court, Mr. Natui explained that he had fully repaid the amount after realizing the procedural oversight and that the purchases occurred during the COVID-19 pandemic, a time when crime was on the rise and access to necessary police equipment was severely restricted. He acknowledged the breach of orders but insisted he acted with good intentions.
On February 6, Magistrate Yogesh Prasad stated in his ruling that the evidence did not indicate any malicious intent on Mr. Natui’s part, and emphasized, “The prosecution has not proven its case beyond a reasonable doubt that the accused, through his actions, obtained any gain.”
This case highlights the complexities in law enforcement operations and the challenges faced by officers during unprecedented times, showcasing the importance of good faith actions in the line of duty.
