The Fijian Government has announced its decision not to appeal the recent High Court ruling concerning former FICAC Commissioner Barbara Malimali. This decision follows careful and deliberate consideration, which included legal advice and consultations with the President.

In a statement, the government expressed appreciation to the Judiciary for its thorough and independent handling of the case, highlighting the importance of the ruling in maintaining justice and fairness across the nation. The ruling emphasizes the strength of Fiji’s legal framework, which upholds the separation of powers and ensures that judicial decisions remain free from political influence.

Despite the initial decision that was subject to judicial review being based on advice from a prominent King’s Counsel, the government reiterated its full respect for the court’s ruling. The statement acknowledged the constitutional role of the Judicial Services Commission in resolving the matter, reiterating the government’s commitment to upholding the rule of law, constitutional processes, and the autonomy of the judiciary.

Prime Minister Sitiveni Rabuka emphasized the government’s confidence in Fiji’s democratic institutions and reinforced its dedication to good governance, accountability, and the independence of the judiciary. In a show of gratitude, Malimali’s lawyer, Tanya Wakanika, shared her appreciation on social media, thanking both the Lord and the Fiji government for the supportive outcome.

This decision reflects a hopeful commitment towards maintaining the rule of law and respect for judicial independence, ensuring that the principles of democracy are upheld in Fiji.
